!PYNQ LLC provides FO2.app as a secure file transfer service. These Terms govern your use of the website, dashboard, recipient flows, and related APIs.

By accessing or using FO2.app, you agree to these Terms of Service. If you do not agree, do not use the service.

1. Eligibility and account responsibility

You must have authority to use the service for yourself or on behalf of your organization. You are responsible for the accuracy of information you provide, the activity under your account, and maintaining the confidentiality of access links, credentials, wallet instructions, and billing details associated with your use.

2. Service scope

FO2.app is a narrow file transfer and delivery product. It provides sender sign-in, direct uploads, recipient delivery links, plan billing, and certain agent-facing APIs and payment flows. We may add, remove, or modify features at any time.

3. Acceptable use

Do not use FO2.app for unlawful, fraudulent, abusive, or infringing activity.
Do not attempt to bypass rate limits, plan limits, payment checks, security controls, or recipient protections.
Do not upload malware, harmful code, or content you do not have the right to transmit.
Do not interfere with the service, related infrastructure, or other users.
Do not use the service to send spam, harassing communications, or deceptive recipient notices.

4. Your content and permissions

You retain ownership of your content. You grant us a limited right to host, process, transmit, scan, format, and display the content only as reasonably necessary to operate, secure, and support FO2.app. You represent that you have the rights and permissions necessary to use the content with the service and to send it to your intended recipients.

5. Billing, subscriptions, and agent payments

Paid plans for human users are billed through Stripe. Fees are due as described at checkout and may renew automatically until canceled. Agent usage-credit top-ups, when enabled, may require Base USDC payment instructions and on-chain confirmation before credits are applied. Payments are generally non-refundable except where required by law or where we expressly agree otherwise.

6. Suspension and termination

We may suspend, restrict, or terminate access to FO2.app at any time if we reasonably believe you violated these Terms, created risk for the service or others, failed to pay required fees, or used the service in a way that is unlawful or harmful.

7. Third-party services

FO2.app relies on third-party infrastructure and service providers, including payment processors, storage/database vendors, hosting providers, and email-delivery vendors. Your use of those integrated services may also be subject to their separate terms and policies.

8. Disclaimers

FO2.app is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, !PYNQ LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, !PYNQ LLC and its managers, members, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to FO2.app. Our aggregate liability for claims arising out of or relating to the service will not exceed the greater of the amounts you paid us for FO2.app in the 12 months before the event giving rise to the claim or fifty U.S. dollars (US$50).

10. Indemnification

You agree to defend, indemnify, and hold harmless !PYNQ LLC and its affiliates, officers, managers, members, employees, and contractors from claims, liabilities, damages, losses, and expenses arising from your content, your use of FO2.app, your violation of these Terms, or your violation of any law or third-party rights.

11. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or FO2.app will be brought in the state or federal courts located in Colorado, and you consent to that venue and jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. By continuing to use FO2.app after an update takes effect, you agree to the revised Terms.
